Terms and Conditions (T&C)

for the Discord bot "FragBot"

Section 1 - Scope

(1) These Terms and Conditions apply to the use of the Discord bot "FragBot" and all related services, websites, APIs, and features (hereinafter the "Service").

(2) The provider of the Service is:

(hereinafter the "Provider").

(3) Deviating terms of the user do not apply unless the Provider expressly agrees to them in writing.

Section 2 - Service Description

(1) FragBot is a software service that extends Discord servers with automated features.

(2) The Provider does not owe any specific outcome. The provided functions are a voluntary technical service.

(3) The Provider may change, restrict, or discontinue functions at any time.

Section 3 - Requirements and User Responsibility

(1) The user is solely responsible for:
a) configuring the bot,
b) assigning rights and roles,
c) the security of their Discord server,
d) compliance with Discord's terms of use.

(2) The user ensures that only authorized persons have access to administration, bot, or API functions.

(3) Misconfiguration, insufficient rights management, or security gaps on the user side are exclusively the user's responsibility.

Section 4 - Disclaimer for Security Incidents

(1) The Provider is not liable for damages arising from:
a) unauthorized access by third parties (e.g., hacking, exploits, injection attacks),
b) misuse of Discord accounts,
c) compromised tokens, passwords, or OAuth credentials,
d) security issues or malfunctions of Discord or third parties.

(2) The Provider gives no guarantee of complete system security.

(3) The Provider is not liable in particular if external attacks obtain, change, or misuse server permissions.

Section 5 - No Liability for Data Loss and Damages

(1) The Provider is not liable for data loss, data corruption, or faulty data transmission.

(2) The user is obliged to create independent backups of relevant data.

(3) The Provider is not liable for indirect damages, consequential damages, or lost profits.

Section 6 - Limitation of Liability

(1) The Provider is liable only in cases of intent and gross negligence.

(2) In cases of simple negligence, the Provider is liable only for breaches of essential contractual obligations (cardinal duties) and limited to foreseeable damages.

(3) Liability for damages resulting from injury to life, body, or health remains unaffected.

Section 7 - Third-Party and External Services

(1) The Service technically depends on Discord and, where applicable, other third-party providers.

(2) The Provider has no influence on their availability, security, or functionality.

(3) Failures, outages, or security issues of external services do not establish liability of the Provider.

Section 8 - Misuse and Prohibited Use

(1) The user undertakes not to use the Service for unlawful purposes.

(2) The Provider may block or exclude users at any time in cases of misuse, security risks, or violations.

(3) There is no entitlement to use the Service.

Section 9 - Availability

(1) The Provider does not guarantee uninterrupted availability.

(2) Maintenance, updates, or technical disruptions may occur at any time.

Section 10 - Indemnification

The user indemnifies the Provider against all third-party claims arising from the use of the Service or from violations by the user.

Section 11 - Term and Termination

(1) The usage agreement can be terminated at any time without stating reasons.

(2) The Provider may discontinue the Service at any time.

Section 12 - Changes to the T&C

The Provider reserves the right to change these T&C at any time. Changes will be announced in due time.

Section 13 - Applicable Law and Jurisdiction

(1) The law of the Federal Republic of Germany applies.

(2) The place of jurisdiction is - insofar as legally permissible - the Provider's seat.

Section 14 - Severability Clause

If individual provisions are invalid, the validity of the remaining provisions remains unaffected.
